Implied consent from an existing business relationship does not last forever, and implied consent arising from an inquiry expires sooner than implied consent arising from a purchase, so a CRM that stores a single boolean cannot tell you who you may legally message next quarter. Every message needs accurate sender identification and a working unsubscribe honoured within ten business days across every sending system, not just the one that sent it. The failure mode we fix most often is deduplication: a merge routine that keeps the newest record silently destroys the oldest consent evidence, which is the evidence you would need in an investigation.

It makes things clearer, not simpler. Alberta, British Columbia and Quebec have private-sector privacy statutes the federal government has recognised as substantially similar, so within those provinces the provincial law governs and PIPEDA applies mainly to interprovincial and international flows. Ontario has no such general statute, so PIPEDA applies directly to Ottawa businesses. That means the ten fair information principles, meaningful consent, purpose limitation, and individual rights of access and correction are federal obligations enforced by the Office of the Privacy Commissioner of Canada, whose offices happen to be in Gatineau. Ontario does have sector-specific law: the Personal Health Information Protection Act, 2004 governs health information custodians, and the Freedom of Information and Protection of Privacy Act governs provincial public bodies. There is one Ottawa-specific complication worth planning for. The first is Law 25, which modernised Quebec's private-sector privacy regime in three waves: September 22 2022 brought the mandatory privacy officer and confidentiality incident reporting to the Commission d'acces a l'information, September 22 2023 brought consent and transparency obligations, privacy impact assessments for projects and for transfers of personal information outside Quebec, privacy by default and a duty to disclose when a decision is based exclusively on automated processing, and September 22 2024 added the data portability right. The Commission d'acces a l'information can impose administrative monetary penalties reaching CAD 10 million or two percent of worldwide turnover, penal prosecution carries fines reaching CAD 25 million or four percent, and Law 25 also created a private right of action with minimum punitive damages for intentional or grossly negligent breaches. The second is the Charter of the French Language as amended by Law 96. It requires French in commercial communications and, for software and user interfaces made available in Quebec, a French version available on terms at least as favourable as any other language version. If your CRM sends messages to Quebec contacts or exposes a portal to Quebec members, both matter. We scope them separately because a bilingual interface does not satisfy Law 25 and a privacy impact assessment does not satisfy the Charter.

Yes, and for organisations doing government relations from Ottawa it is one of the highest-value things a CRM can do. Under the federal Lobbying Act, in-house and consultant lobbyists register with the Office of the Commissioner of Lobbying of Canada and file monthly returns reporting communications with designated public office holders, which is a defined and comparatively senior set of federal officials. To be clear about scope, we build the system and the workflow; we do not provide legal advice on registrability, and your government relations counsel should sign off on the taxonomy before it goes live.
