That difference is architectural. A US-shaped CRM typically records that a contact exists and treats suppression as an afterthought. A PIPEDA-shaped CRM records why each piece of information was collected, what purpose the individual agreed to, and whether that purpose still applies, because using data for a new purpose generally needs fresh consent rather than an updated privacy page. Withdrawal of consent has to be honoured and has to propagate. Access requests are a real workflow with a statutory response window, so we build an export that assembles everything the CRM, the marketing platform and the warehouse hold about one person rather than leaving it to an analyst with SQL access. Breach reporting has been mandatory since November 1 2018 for any breach of security safeguards creating a real risk of significant harm, with notification to the Office of the Privacy Commissioner and to affected individuals, and a record of every breach kept for twenty-four months whether or not it was reportable. We build that breach register as a system feature, because reconstructing it after an incident is where organizations fail.

Canada's Anti-Spam Legislation has governed commercial electronic messages since 2014, and the parts that matter are the parts a CRM either enforces or quietly breaks. Every commercial electronic message needs either express consent, which the recipient affirmatively gave and which does not expire on its own, or implied consent, which does expire: six months from an inquiry and two years from a transaction or the end of a contractual relationship. That means the platform has to store the basis, the source, the timestamp and the expiry of every consent record, and it has to age implied consent out automatically rather than relying on a quarterly cleanup. Every message needs sender identification and a working unsubscribe mechanism, and unsubscribe requests must be honoured within ten business days. Consent state has to be checked at send time rather than at list build time, because a list assembled on Monday and sent on Friday is a compliance gap. Administrative monetary penalties run up to CAD 1,000,000 for an individual and CAD 10,000,000 for an organization, which is why we treat consent as a first-class service with its own audit log rather than a boolean field on a contact record. Text and app-push programs sit under the same rules as email.

Rarely as a matter of law, often as a matter of contract, and in a CRM estate the question is almost never about the CRM itself. PIPEDA does not require Canadian storage. It requires comparable protection wherever the information travels, transparency with individuals about cross-border transfer, and continued accountability for whatever a processor abroad does with it. The major platforms have Canadian hosting options and those get selected in discovery, so the primary database is the easy part. The exposure sits in the twenty or thirty systems attached to it, and that list is longer than any client expects: the email service provider, the SMS gateway, the enrichment and firmographic vendor, the calendar and meeting recorder, the session replay tool, the chat widget, the support desk, the survey tool, the reverse ETL destination, the sandbox someone loaded with a production extract, and any embedding store built for search. Each one holds contact records, each one has its own sub-processor list, and several will move data to a US region by default. We build a data map naming every one of them, the personal information it receives, the region it lands in and who signed for it, then make each an explicit decision. The same map is what makes a deletion request enforceable, because a withdrawal that stops at the CRM has not actually been honoured.

Quebec is the one province where a Toronto CRM build needs a separate compliance track. Quebec's Law 25 amended the province's private-sector privacy regime in stages: obligations around communicating information for commercial transactions took effect September 22 2022, the substantial governance layer took effect September 22 2023, and the data portability right took effect September 22 2024. The 2023 tranche is the one that changes design. Every organization must designate a person responsible for the protection of personal information. Confidentiality incidents presenting a serious risk of injury must be reported to the Commission d'accès à l'information and to affected individuals. Privacy impact assessments are required before communicating information outside Quebec or launching a system project involving personal information. Technology products offered to the public must have the highest level of confidentiality active by default, without the individual configuring anything. Administrative monetary penalties reach CAD 10,000,000 or two percent of worldwide turnover. Separately, the Charter of the French Language as amended by Law 96 requires that customer-facing software and user interfaces offered in Quebec be available in French on terms no less favourable than any other language version, and francization duties now reach enterprises with twenty-five or more employees in Quebec. A portal, a preference centre and a transactional email template are all in scope.

Yes, and the first thing worth correcting is the compliance story usually attached to it. There is no comprehensive federal artificial intelligence statute in force in Canada. The Artificial Intelligence and Data Act travelled as Part 3 of Bill C-27 and died on the Order Paper when Parliament was prorogued on January 6 2025, so a scoring engine cannot be built to AIDA and no one can certify it against AIDA. What does apply is concrete. Quebec's Law 25 requires that an individual be informed when a decision is based exclusively on automated processing, and gives them the right to be told the personal information used and the principal factors involved, and to make representations to a person who can review the decision. Ontario's Employment Standards Act requires, for publicly advertised job postings on or after January 1 2026 by employers with twenty-five or more employees, that the posting disclose the use of artificial intelligence to screen, assess or select applicants, which reaches any recruiting CRM. PIPEDA's accountability and access principles still apply to the inputs. So we build scoring with a documented feature set, exclusion of proxies for protected grounds, a stored explanation for each score, a human review path, and a routing layer that logs why a lead went where it went.
