On the Michigan side, the Identity Theft Protection Act, 2004 PA 452, requires notice to Michigan residents without unreasonable delay after a qualifying breach under MCL 445.72, and the Social Security Number Privacy Act, 2004 PA 454, requires a written policy if you touch SSNs. Both belong in your incident response plan.

The Preservation of Personal Privacy Act, 1988 PA 378, MCL 445.1711 through 445.1715, is Michigan's sleeper privacy statute and it is popularly known as the Video Rental Privacy Act. Section 2, MCL 445.1712, prohibits a person engaged in the business of selling at retail, renting, or lending books or other written materials, sound recordings, or video recordings from knowingly disclosing a record that personally identifies a customer as having purchased, leased, rented, or borrowed those materials. It carries a private right of action. It was amended by 2016 PA 92, effective July 31 2016, which is curative in nature and clarifies that disclosure incident to the ordinary course of business, including marketing to customers when written notice is provided, is not prohibited, and that a civil action may only be brought by a customer who suffered actual damages. Under MCL 445.1715 a customer with actual damages may recover those damages including emotional distress, plus reasonable costs and attorney fees. If your product sells media, books, audio, or video, or handles subscriber lists on behalf of publishers or retailers, this statute reaches your data sharing design. We flag it in discovery because it is routinely missed by teams who assume Michigan has no privacy exposure.

SOC 2 stops being optional the moment you get your first security questionnaire from a Tier-1 supplier or a health system, and in this market that comes early. We treat it as an engineering output rather than a document exercise. From sprint one that means infrastructure defined in Terraform so access and configuration are reviewable, centralized identity with enforced MFA, least privilege IAM, encrypted data at rest and in transit with managed keys, structured audit logs covering authentication and privileged actions, dependency and secret scanning in CI, and change management that flows through pull requests with required review. A compliance automation platform such as Vanta, Drata, or Secureframe collects the evidence, but the controls have to be real underneath it. Type I is a point in time attestation and is achievable within a few months of the controls going live. Type II requires an observation window, typically three to twelve months, so the practical advice is to turn controls on early and start the clock. Separately, automotive customers increasingly ask about TISAX and healthcare customers will want a business associate agreement and a HIPAA security risk analysis, which are different frameworks with overlapping evidence. Treat that one as unsettled rather than fixed: the CFPB issued an advance notice of proposed rulemaking on August 22 2025 reconsidering the rule, so the compliance dates and some of the substance may move. We build the authorization and revocation model to the published rule while keeping it configurable, which is the cheapest hedge available while a rulemaking is open. If you touch card data, PCI DSS applies and the cheapest answer is nearly always to keep cardholder data out of your systems entirely by tokenizing at the edge. State licensing matters too: mortgage brokers, lenders, and servicers in Michigan are licensed under the Mortgage Brokers, Lenders, and Servicers Licensing Act, and your customers' obligations flow to you through contract. Shared services that hold no personal data, such as feature flags, billing metadata, and product analytics with identifiers stripped, can stay central, and you document that split rather than discovering it during a Canadian customer's privacy review. Backups, log aggregation, and any third party subprocessor also have to respect the boundary, which is where most implementations quietly leak. Retrofitting this after a hundred tenants is a migration project measured in quarters. Building the resolver on day one costs a sprint.
